1. Acceptance of Terms
By accessing or using Pixelcart, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility
You must be at least eighteen (18) years old and legally capable of entering into binding agreements to use the Service.
We reserve the right to request identity verification, including government-issued identification or other supporting documentation, at any time to verify compliance with these Terms, prevent fraud, or comply with legal obligations.
3. Marketplace Status
Pixelcart is an online marketplace platform that enables users to upload, display, discover, purchase, sell, and otherwise transact in photographic content.
Pixelcart acts solely as an intermediary platform connecting users. Unless expressly stated otherwise, Pixelcart is not the creator, seller, buyer, owner, licensor, licensee, or contracting party with respect to user-generated content or transactions conducted through the Service.
Users are solely responsible for the content they upload, the transactions they enter into, and any agreements or arrangements made with other users.
4. User Accounts
You are responsible for:
Maintaining the confidentiality of your account credentials
All activity occurring under your account
Providing accurate, current, and complete information
Promptly updating account information when necessary
We may suspend, restrict, or terminate accounts that provide false information, engage in fraudulent activity, or violate these Terms.
5. User-Generated Content
5.1 Ownership and Responsibility
You retain ownership of the content you upload, including photographs, descriptions, metadata, and related materials.
By uploading content, you represent and warrant that:
You own or control all rights necessary to upload and make the content available through the Service
The content does not infringe any copyright, trademark, privacy, publicity, contractual, or other rights
Any required permissions, releases, or consents have been obtained
The content is lawful, accurate, and not misleading
You are solely responsible for all content you upload, publish, or distribute through the Service.
5.2 Prohibited Content
You agree not to upload, publish, distribute, or make available content that:
Violates any applicable law or regulation
Infringes intellectual property rights
Contains unlawful, defamatory, abusive, threatening, or harassing material
Promotes violence, hatred, discrimination, or exploitation
Violates privacy or data protection laws
Contains malicious code, malware, or harmful software
Is fraudulent, deceptive, or misleading
5.3 License to Operate the Service
By uploading content, you grant Pixelcart a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, distribute, process, and otherwise use the content solely for the purposes of operating, maintaining, securing, improving, and promoting the Service.
This license ends when the content is permanently removed from the Service, except to the extent necessary for backups, legal compliance, dispute resolution, or technical operations.
6. Content Moderation and Enforcement
We reserve the right, but are not obligated, to:
Review content and user activity
Remove, disable, restrict, or refuse access to content
Suspend or terminate accounts
Refuse service to any user
Such actions may be taken where we reasonably believe that content or conduct:
Violates these Terms
Infringes intellectual property rights
Is unlawful or harmful
Creates legal, security, or operational risks
Interferes with the proper functioning of the Service
7. Intellectual Property Complaints
If you believe content available through the Service infringes your intellectual property rights, you may submit a complaint to [email protected].
We reserve the right to investigate complaints and remove, restrict, disable, or preserve content while claims are reviewed.
Users who repeatedly violate intellectual property rights may have their accounts suspended or terminated.
8. Identity Verification (KYC)
To protect users, prevent fraud, and comply with legal obligations, we may:

Perform manual or automated verification procedures
Require additional information regarding account activity
Failure to cooperate with verification requests may result in suspension, restriction, or termination of access to the Service.
9. Facial Recognition and Biometric Data
Pixelcart may use facial recognition technologies and related biometric processing to enhance platform functionality, security, fraud prevention, identity verification, content organization, search capabilities, or other legitimate platform purposes.
By using the Service, you acknowledge and agree that:
You will only upload images where you have obtained all necessary permissions, consents, and legal authority required for such processing
You are responsible for ensuring compliance with applicable privacy, biometric, and data protection laws
You will not upload content in violation of any individual's legal rights
Where biometric data is processed, Pixelcart will implement appropriate technical, organizational, and security measures and process such data in accordance with applicable laws, including the GDPR where applicable.
10. Data Protection
We process personal data in accordance with applicable data protection laws and our Privacy Policy.
Users may have rights including:
Access
Rectification
Erasure
Restriction of processing
Objection to processing
Data portability

11. Transactions Between Users
Transactions conducted through the Service occur between independent users.
Pixelcart does not guarantee:
The accuracy of listings
Ownership claims made by users
The quality, legality, authenticity, or suitability of content
The performance of users
The successful completion of transactions
We may, but are not obligated to, assist in resolving disputes between users.
12. Fees
Pixelcart may charge fees, commissions, subscription charges, processing fees, or other amounts in connection with the Service.
Applicable fees will be disclosed through the platform and may be updated from time to time.
Continued use of the Service following any fee update constitutes acceptance of the revised fees.
13. Service Availability
The Service is provided on an "as is" and "as available" basis.
We do not guarantee that the Service will be uninterrupted, secure, error-free, or continuously available.
We may modify, suspend, discontinue, or restrict any part of the Service at any time without liability.
14. Limitation of Liability
To the fullest extent permitted by law:
The Service is provided without warranties of any kind, whether express or implied.
Pixelcart is not responsible for user-generated content or transactions between users.
We shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.
To the maximum extent permitted by law, the total liability of Kattouf Internet Services Ltd. arising out of or relating to the Service shall not exceed the greater of:
(a) €1000; or
(b) the total fees paid by you directly to Pixelcart during the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Kattouf Internet Services Ltd., its directors, officers, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from:
Your use of the Service
Your content
Your transactions with other users
Your violation of these Terms
Your violation of any law or third-party rights
16. Account Suspension and Termination
We may suspend, restrict, or terminate access to the Service where reasonably necessary to:
Enforce these Terms
Protect users or the platform
Investigate misconduct or fraud
Comply with legal obligations
Address security concerns
Termination may occur with or without prior notice where permitted by law.
17. Force Majeure
We shall not be liable for any delay, interruption, or failure to perform resulting from events beyond our reasonable control, including natural disasters, internet failures, cyberattacks, labor disputes, governmental actions, war, terrorism, or failures of third-party services.
18. Changes to the Terms
We may modify these Terms from time to time.
Updated versions will be posted on the Service with a revised effective date. Continued use of the Service after such changes become effective constitutes acceptance of the updated Terms.
19. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Cyprus.
The courts of Cyprus shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable law provides otherwise.
